NJBIA Praises Regulatory Reform Enactment

New Jersey employers will find it easier to respond toregulations proposed by state agencies thanks to NJBIA-backed legislationreforming New Jersey's regulatory process that was signed into law by GovernorChristie Whitman Tuesday.

"This law is a long overdue reform to one of the most persistent andonerous problems our members have faced-the massive tangle of regulationsput forth every year by New Jersey's bureaucracies," said NJBIA PresidentJoseph E. Gonzalez Jr.

"Our members have consistently cited New Jersey's regulatory processas one of the biggest obstacles to economic growth," Gonzalez continued. "With this law, employers can be assured that they will be able to understandfuture regulatory proposals, that they will have sufficient time to commenton them, and that there will be some consideration to balancing the costof implementing proposals with the benefits they are intended to provide.

The law-sponsored by Assembly Members Rose Heck and Kevin O'Toole andSenators Martha Bark and John Adler-makes many changes to the way New Jerseyregulations are promulgated and public comment is solicited.  Amongthem are:

  • mandating that state agencies give ample advance notice before issuingnew regulations;
  • requiring meaningful regulatory impact statements that include a cost/benefitanalysis; and
  • writing regulations in plain English instead of technical jargon.
Gonzalez pointed out that the business community has been lobbying forthis bill since 1987.  He praised former Assemblyman and US Rep. BobFranks, who developed the legislation as part of his SCORE commission reportin the 1980s.  

"Many people have worked long and hard on this bill to make it a reality. They have the thanks of business owners throughout the state," Gonzalezsaid.  "On behalf of the business community, I thank the law's sponsorsfrom both parties and I especially want to recognize Assemblywoman Heckfor bringing this bill to fruition."
