Environmental Regulatory NewsIndustry Groups Lead Discussion of Proposed Changes to Site Remediation Technical Regulations

Representatives of two industry groups recently met with the NJ Department of Environmental Protections (NJDEP) to offer proposed changes to the Department's technical regulations for site remediation that are the controlling standards from all industrial cleanup activities.
Ed Hogan from Porzio, Bromberg and Newman and John Hannig from Exxon Mobil led the industry discussion of extensive changes to the technical regulations at NJDEP's quarterly meeting of the Site Remediation Advisory Group (SRAG). Hogan, NJBIA Environmental Quality Committee vice chair is the spokesperson for TRAC Technical Regulations Advisory Committee (TRAC). Hannig is the spokesperson for Site Remediation Industry Network (SRIN). The two groups coordinated their presentations on a variety of changes that could, if adopted by the NJDEP, decrease costs and improve the time frame for completing cleanups.
Industry is using the sunset deadline for these regulations to drive productive changes in the regulations that will decrease the cost of cleaning up industrial property and decrease the time for project approval. The regulations are scheduled for introduction later in 2001.
The purpose of SRIN is to gather informally to discuss experiences and concerns with various site remediation activities (Natural Resource Damages, risk assessment, groundwater standards, etc.). It is an opportunity for company representatives to share insights, knowledge, or issues with other company representatives. Membership to SRIN is at no-charge and meeting attendance is optional but encouraged. Only members of industry are allowed into SRIN. There are no consulting firms (legal or environmental) in SRIN.
TRAC was formed in April 2001 and met throughout the second quarter. NJBIA Environmental Network Vice-chair Ed Hogan and NJBIA First Vice President Jim Sinclair formed the TRAC committee to develop comments from a wide variety of consultants; environmental professionals, lawyers and small business people concerning the readoption of the Site Remediation technical rules. TRAC formed subgroups and prepared issue papers. This group complements and expands the scope of the SRIN efforts.
